Welcome to Ohana Exchange — a Hawaii-based online marketplace built to support local creators, artists, and small businesses. By creating a seller account and listing products on Ohana Exchange, you agree to the following terms and conditions.
1. Becoming a Seller
To sell on Ohana Exchange, you must:

Be at least 18 years old or have legal permission to operate a business.

Create an account with accurate and up-to-date information.

Agree to follow all local, state, and federal laws related to your products, taxes, and sales.

List only products that you own or make.
Ohana Exchange reserves the right to approve or deny any seller account at its discretion.
2. Seller Fees & Payments
Sellers agree to the current pricing structure of the platform, which may include:

Payments for sold items are processed securely through the site’s payment partner.

Sellers are responsible for keeping valid payment and payout information in their account.

Fees and payouts may be adjusted for refunds, chargebacks, or cancellations.
Ohana Exchange may update its fee policy with advance notice to all sellers.
3. Product Listings
Sellers are responsible for ensuring that all product listings are:

Accurate, complete, and clearly priced.

Free from misleading or false descriptions.

Accompanied by clear, original photos that represent the product being sold.
Products prohibited on Ohana Exchange include (but are not limited to):

Counterfeit, illegal, or stolen goods.

Weapons, alcohol, or restricted items.

Offensive or discriminatory materials.
Ohana Exchange may remove listings that violate these terms.
4. Order Fulfillment & Shipping

Sellers must ship items in a timely manner and include any shipping fees or times clearly in their listings.

Sellers are responsible for lost or damaged shipments unless otherwise agreed upon with the buyer.

Tracking numbers or proof of shipment are encouraged for all orders.
Failure to deliver items may result in refunds being issued to the buyer and potential removal from the marketplace.
5. Cancellations, Refunds & Returns

Sellers are expected to handle customer issues respectfully and promptly.

Each seller must clearly state their return or refund policy in their shop.

Ohana Exchange reserves the right to mediate disputes but is not legally responsible for refunding orders on behalf of sellers.
6. Taxes & Legal Compliance
Sellers are responsible for reporting and paying any taxes owed from sales made through Ohana Exchange. Ohana Exchange does not collect or remit taxes on behalf of individual sellers unless required by law.
7. Intellectual Property
By uploading content (photos, text, logos, etc.), sellers grant Ohana Exchange permission to use that content for marketing and promotional purposes. Sellers retain full ownership of their work but agree not to upload copyrighted material without proper rights or permission.
8. Community Standards
Ohana Exchange is built on the values of respect, integrity, and aloha.
We expect all sellers to:

Represent Hawaii’s creative community with honesty and care.

Avoid spam, harassment, or misleading conduct.
Failure to follow these standards may result in account suspension or removal.
9. Platform Rights
Ohana Exchange reserves the right to:

Remove content or listings that violate these terms.

Update these terms and notify sellers of any major changes.
10. Liability
Ohana Exchange provides the platform “as is” and is not responsible for:

Any damages or losses related to use of the platform.
Sellers use Ohana Exchange at their own risk and are solely responsible for their products and customer interactions.

By using Ohana Exchange as a seller, you agree to these terms and acknowledge that you have read, understood, and accepted them.
